Is that debt collector for real?

It’s stressful enough getting calls from debt collectors for bills you actually owe. But if you’ve ever been harassed and threatened for debts you’ve never even heard about, let alone accrued, it can be downright harrowing – and quite possibly illegal.

Today, the FTC announced that a U.S. district court has temporarily halted a Georgia-based operation from using deception and threats to collect millions in phantom payday loan “debts.”  The FTC says Williams, Scott & Associates and company president John Williams lied and threatened people to pay on debts they didn’t owe – or debts the company didn’t have the authority to collect.

According to the FTC, the debt collectors claimed to be federal and state agents, investigators, or members of a government fraud task force, or they pretended to be with a law firm.  They falsely told consumers their driver’s licenses would be revoked and that they faced immediate arrest and imprisonment if they didn’t pay up.  How did the debt collectors even know to contact those consumers?  The FTC says many of the people had inquired about a payday loan online at one time and submitted contact information, which the company later got its hands on.  The case is pending in federal court in Atlanta.

Don’t get intimidated by a bullying bill collector – real or fake.  Any debt collector impersonating a law enforcement officer or threatening you with immediate arrest if you don’t pay up is violating federal law.

If you think a caller may be a fake debt collector:

  • Ask the caller for his name, company, street address, and telephone number. Tell the caller you won’t discuss any debt until you get a written "validation notice." If the caller refuses, don’t pay.
  • Put your request in writing. If you have the caller’s address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. The Fair Debt Collection Practices Act (FDCPA) requires any debt collector to stop calling if you ask them to in writing.
  • Don’t give or confirm with the caller any personal, financial, or other sensitive information. Fake debt collectors, and other scammers, can use your information to commit identity theft and other crimes.
  • Contact your creditor.  If a debt is legitimate – but you think the collector isn’t – contact your creditor.  Tell them about the suspicious call and ask who, if anyone, the creditor has authorized to collect the debt.
  • Report the call. File a complaint with the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA.

So I haven't read all the entry and I'm having a hard time finding info on this. I have a company called State Wide Mediation calling me. Mind you they have never called me. A lady by the name Alex Black! Said she was an investigator looking for me she called My work and my wife. When ask to give me validation of debut in writingthey said they would only do that since they are not a debut collector but a mediator. Is this true is there a difference between a mediation group and a debut collector!

This may be a scam. Some bogus debt collectors impersonate attorneys, law firm staff, judicial employees and mediators, and falsely threatened people with lawsuits, seizure of their property, or wage garnishment. All of these practices are against the law.

It’s important to understand your rights if you’re ever contacted by a debt collector. And if you believe a collector has violated those rights, the FTC wants to hear about it. Your complaint gives us a lead to follow up on, and may stop it from happening to someone else.

Stating i owe for a defaulted pay day loan which I do because i was unable to pay itback due to job loss and he said if I dont pay 522.00 i full today i will be issued a warrant and do 90 days in jail and receive a felony he would not give his company namr when i asked and just continued talking about payment. How can i find out if this is a scam?

If you know you owe a debt, you can contact the lender and ask about your account. You can ask the lender about making a payment, and ask the lender told someone to call you about the debt. The caller might be a fake debt collector. Even a fake debt collector can know a lot about you like your name, address and how much you borrowed.

I have received 2 calls in the past 4 months from a CFS Pre-mediation Firm(numbers 855-443-0494 & 855-443-8715). Stating that they were calling a "compliant" against me for an online payday loan that they picked up in 2011. They said I needed to pay or they would have the local Sheriff's office serve me with count papers. They had some really personal info and scared me into making payment arrangements. However, after reading all of these comments and making a few calls back to them. They will not provide me with written validation of the debt or give me their address. I'm convinced it is FRAUD and will not be paying them. My question is, for all of the people being threaten with court papers, did any of you get served? Please respond.

I just wrote something very similar to this, but they told me they were going to the court house today. We never took an online loan out, so we knew that was false. The number that called us was 855 206 9679. They had personal info on my husband too. Sounds like maybe the same company...

I received a call from Retrival mediation services 786-270-9510 ext 208- stated due to not paying payday loan from 2011 would escalate to check fraud and would have my wages garnished. I asked them to contact me in writing as I didn't have a clue about what they were about. Rfeused to send me any info in writing. Then proceeded to call my place of business and ask for the fax number. My secretary didn't know who they were and gave it out. I then received a fax addressed to Human Resources no where is my place of business addressed. I work for a big hospital and the fax came to my unit. Received a message on my VM this morning. Was advised that due to lack of cooperation would be escalated to federal. Then he wished me good luck at the end of the message.

I received an email from a company called THE Legal Processing Firm 254)313-9276 out of Waco, Tx telling me they were serving me with notice on a deliquent payday loan taken out December 26, 2011 with Wells Fargo. One, I wasnt at a computer until late that night on that day since I was coming back from KY visiting family. Two, I had not had any dealings with Wells Fargo for three years. This jerk was rude and would not supply the information I asked for. He said by the time I received it judgement would be against me and I would owe the original amount (1,000) plus 900.00 for their fees but he could settle for 350.00. I told him to send me the information and I would show it to my attorney.

I received a phone call from Keith Rivers (949)416-3245 today about processing a claim against me and that he needed my address to add me to his route for today. He sounded surprised that I didn't know anything about it. He said that he has a sealed envelope to deliver to me. He could not tell me anything about it except that it said Atlantic on the outside, had the phone number 855-201-4994 and a claim number attached to the order.

I then asked him what company he worked for. He told me he was an independent contractor. I asked him what the name of his own company was. He told me he was self contracted. I asked him what his profession was - self contracted as a what? He said he was retained by the company to process the claim against me. He said I should call the Atlantic number and that he would call me back in an hour to work out delivery.

As a female who has been a victim of a violent crime, I don't give out my address to strangers - especially strangers that call me up saying they want to show up in person. I again asked him to identify himself or provide me more information about the person requesting my physical location. He would not give any further identification of himself. He hung up on me.

Shady. Keith Rivers, if you're reading this, you can leave whatever you have for me at the local police station and I'll have my husband pick it up. You won't identify yourself, why would I give you my home address?

A collector called from 8552011521. Asked me to pay a internet loan from 2010. When i asked for validation he told me i would have to pay $200 to release it from mediation..then they would send me more info...??? I said i would not pay anything until i had documentation stating that it was mine. Agent kept asking to set up future payment plans. I checked my credit report and there was nothing on there pertaining to that... what should I do?

If you know you have a debt for an online loan, you can contact the lender for information about your account.

If you don't recognize the debt the caller is talking about, and he refuses to send you a validation notice with details about the loan, it could be a scam.

I just got a harassing phone call from a supposedly debt collector. With the names associated with Kathy King and Linda Sparks case number 2016-17230 phone number 866-805-4490 they refuse to give much information. I want to know if this is a legitimate company.

If you know you have a debt, you can contact the company you owe and ask about your account. You can ask if the company hired people to make calls to collect debts. If you owe money and a debt collector contacts you, tell them to send you a validation notice. You have rights when debt collectors call.

If you know you don't owe the debt the people called about, they might be fake debt collectors. Fake debt collectors may have some information about you, and they call and threaten to arrest you or do other drastic things. They're trying to scare you into sending money, when you don't really have a debt.

I just got an email from a supposively debt collector. The email is a little intimidating but I'm sure its a scam. Has anybody seen these?

The person email is mjohnsondebtcollector          which I figured a debt collector wouldn't have gmail. She is referred to as a Senior Attorney. Has anybody seen these? Anything I can do to stop this?

The FTC does not investigate the debts of individual people. The person who made up this email is lying about that.

The email may be from a fake debt collector, who's trying to scare you into answering or sending money. You don't have to respond. Don't give personal or financial information to someone just because he claims to be a debt collector. This FTC article explains your rights when you deal with a debt collector.

In 2010 I was sued by Anthony Wayne Credit Adjusters for $384. Supposedly, this was a debt from March, 1991, although no original creditor was named. The "magistrate" who heard my case was the same girl who had been sitting at the reception desk answering the phone when I first walked in, and she "found for the plaintiff" even though I was in the Navy at in March of 1991, halfway around the world. When I asked for a transcript of the hearing, I was told the proceedings were not recorded. Then, somehow, thet managed to garnish my Veterans Benefits to satisfy the judgment on a time-barred debt that wasn't even mine! I filed a complaint with the FTC and begged for their help but, naturally, they wouldn't even investigate. I'm getting pretty tired of being screwed over by people just because they KNOW they can get away with it.

Been speaking with men at phone number 8664189423 a guy by the name Alexander Brown is threatening to sue and file fraud charges against my husband for a 689 charge (they claim) from us bank almost ten years ago. When we asked for a letter to validate the debt they refused to mail stating they were not required to do so since they said they already have (we have received nothing). We called them after the left messages on my in laws cell phones about my husband. When I tried to deny setting up a payment plan with them till we saw proof of debt owed he told me he would forward to our fraud department and my husband would get a class c felony. The man was also very rude, wouldn't let me talk, wouldn't let me ask any questions and told me I had five mins to call him back to set up payment arrangements or he would forward to fraud department and then hung up on me. He left me crying and very shaken up. This can't be real right?

If someone calls you about a debt, and you know you don't owe it, the caller could be a fake debt collector.

A fake collector might:

  • demand payment of a debt you do not recognize
  • refuse to give you a mailing address or phone number
  • ask for personal or financial information
  • try to scare you into paying, by threatening to have you arrested or reported to law enforcement.

This FTC article about fake debt collectors has tips on how to deal with the caller.

Just received this text message.

Hi, Legal notification from Financial Crimes Enforcement Network regarding your outstanding pay day loan for $586. Where principal amount was $300. We (1/4) are going to forward this case in court house with pressing three serious allegations. Within next 48hrs, one of our paralegal officer and your local (2/4) sheriff officer will contact you with paperwork, fraud evidence and warrant of arrest. You need to text us back (202) 844 7192. If you have any intention (3/4) to resolve this matter. Thank you(4/4)

Looks like with the same companies and the same tactics being used over and over that the "ftc" isn't doing ANYTHING except protecting the debt collecting companies and only giving lip service to the Tax Payers. The "debt collectors" could not and would not do anything if they didn't know how inept the ftc was at enforcing the "laws".

The FTC has taken legal action against dozens of debt collectors. Take a look at this list of banned debt collectors; you can read about the cases and view the court orders too.

I had a call today that came across as a Columbus, OH phone number (I am in Ohio but not Columbus) the number was 614-859-1233 (supposedly somewhere on Solitaire Ln.)

Her name was Andrea. She said she was a contracted firm working with the State & Federal Arbitration Firm and the District Attorney's office. She then proceeded to tell me that I am having 2 Felony Bench Warrants issued for my immediate arrest due to fraud charges involving my SSN and Name. I asked her to give me details and she said she was not allowed to discuss the case with me, but needed my direct statement regarding the charges. This statement would not get rid of the charges, but notify the company that I understood what was happening and "accepting my wrong doing" as she put it. I then explained to her that this was not possible as I have never had any fraud issues with checks. And she kept ignoring me and asking me if I wanted to be arrested and that officers were standing by to be told that they could come find me! She wouldn't give my any information other than a generic excuse of what her company's name was and what they actually did and her first name. NO address. Oh she did give me a Pennsylvania number to call to work this out (again if it is state, I am in OH, why am I supposed to call PA?) which was 215-259-4108. I did call the number to be curious, and it sounded like the same exact woman but changed her name from Andrea to April!!!

I don't understand how they are getting away with this? If I hadn't watched a friend go through this about a year ago, I wouldn't have known any better. I am a young woman, trying to get on her feet and do what I need to do to be successful working person in society and people try and pull this stuff?! I had a co-worker who actually sent them money 2 years ago, $345 to be exact (because she didn't know it was a scam at the time- this was 3 or 4 years ago) and never received confirmation that the debt was paid off, and to this month still receiving calls about the same exact debt! I have read this webpage and will be reporting as much information as I have to the appropriate people. But it won't stop them. Some other poor, worried person will send them money or let them harass them. It's disgusting.

Got a call yesterday from 855 206 9679, got an automated voicemail saying that there was a complaint against (my husband) and if we knew his whereabouts, to call back. Called me, my mother in law, and sister in law. I called them back today and they told me that he had taken a loan out in 2013 for $300.00 and that he owed $430.00. They couldn't tell me who the loan company was, but told me that it was done online. They had our correct physical address (at the time), my e-mail, the last 4 of his bank account number, and his social security number. After calling, this morning, they told me if he didn't call them by 1 pm eastern they were going to have to go to the local courthouse for subpoena papers for court and something about a warrant. He was at work, he couldn't call. I went to my bank and they printed statements for like 6 months in 2013, there was no deposit from any company, besides his job, and there was no attempt for any company to take money out. I've not only talked to the bank, but other people and they feel it is a scam. They say the name of the company is Western Mediation Firm, I didn't think to get the address, but the number i posted above got me through to them. I even got an extension 540 and spoke to a "supposed" Brook Sanders, she said she was over his case. Has anyone else ever heard from this company? Things just didn't add up and we never took the loan out...

I dont know if this is scam or not? because I tried to call this number and he hung up on me and then the call wont ring or go through ...

I have been getting phone messages from a person claiming to be Ann Walker (813-577-3877) and working at Cain & Daniels, Inc. They are offering to negotiate payments for a settlement/judgement of a claim by Culpepper Properties against my company. I've neither heard of any settlement, judgement or Culpepper Properties, nor have I received anything in the mail. I call back and and leave messages asking them to send me a letter, but they keep calling. On-line reviews of Cain & Daniels, Inc. suggest a scam even though they have a company website. Have others heard of this approach?

I got a call from a 904-775-3613, saying I owed on a payday loan. I asked what the company Was and he told me a bunch of companies combine. I asked for verification, so I could see details. So he sent Mr a letter. It is from debt mediation services. It says how much I owe, hoiw much they would settle for, but no name of payday loan company. The guy said he could garnish my wages, I am retired, freeze my bank account. Anyone else get contacted by thiuthius company?

Debt collectors make up to one billion contacts with consumers each year. It’s their job to make sure they’re collecting from the right people. But sometimes, they reach the wrong person. Other times, they’re actually part of a fake debt collection scam.

If you don’t recognize a debt, here’s what you can do.

Called with an intent of intimidation. Saying a warrant would be issued as well as check fraud charges. Called PD of area they claim they were representing ie. Pomona California; was told its scam, hang up and ignore. Filed a complaint with the FTC as well. A lady by the name of Darryl Lynn claiming to be an LA County litigator at number 512-553-3212. Says debt from a cash advance was owed needed to be paid by Friday August 5,2016 to avoid arrest. Amount asked for was $527 and to be transferred via Money Gram. Says she was calling from "Legal Consultant Services".

They sent me an email today stating Ibroke federal laws and have a few days to pay 1300.00 or I will be brought to court,

They are useless. They called me last year and called a family member in another state saying they had a warrant number. Bunch of scum fraudulent losers who cant get real jobs.

Has anyone been harassed by an Officer Benson claiming to be a warrant officer for a Legan Consultant Services LLC, with a 615 area code?? They said I had a "payday loan" of $200, and that I needed to pay $400+, then after that another $520+ then an exoneration few of $200+.. They send "company emails" as if it's a child using a cell phone, one girl emailed back a "yw" after I asked for a document and said thank you.

They have been threatening me with being served, with jail time, with INSANE legal fees, all kinds of stuff. This "officer Benson" even cussed ou My husband on the phone. I have felt terrified, bullied, harassed and I am just physically sick with worry, and not knowing if this is real or what..

Recieved a voicemail today from 512 265 8015. "Compliance Officer: Torrie" a man pretending to be a female told me that in 2012 I had given a check as collateral for a loan I had taken out with EZ Money. That the check had bounced and the account was closed soon after. I was demanded to pay 935 dollars right then and there or "paperwork" would be sent out for check fraud, a felony warrant would be put out for my arrest, and I would have to pay 50,000 dollars in the end. I told them that this was the first time i'm hearing about this and didnt exactly have 900 dollars just laying around. He got angry and said that he would send the paperwork out with a flat "no compliance" on record. I got scared and called my laywer, my lawyer searched the name and number and it turned out it was a scam. I called him back to let him know I was unto him and he became irratic. I simply blocked the number. Its a shame these people have to prey on people that go to work hard for theirs everyday. I now have a personal vendetta out for him.

I receive emails and calls from these types of places saying i owe 1700..I know this is a scam because ive been living in arizona and they dont do payday loans in that state...further more i havent been employed for a couple years since i been going to school and taking care of my daughter..so i highly doubt they would allow me to borrow any money without verifying a source of income!! This is crazy.

Yah these people got me. I was so scared that I actually end up paying over $1,000 to one of them. Then another called my dad threaten his social security number & credit so we got scared ended up paying them over $1,000 also. Then I got emails, like about 2 almost every day, telling me the same thing. So I called a Payday loan debt relief consultant and he automatically told me that they are all scammers. Yeah so it pissed me off because they ended up getting more than $2,000 out of me & my family. Scaring me & my dad, oh I was livid. I'm still getting emails but I just ignore them and got a new email account.

I received a call from 866-581-2871 saying his name was Rick Vargas from the criminal investigations services and that I was pending charges of financial fraud to call him back right away to help myself. tried calling number but got nothing. I have no clue what he is talking about. this is the 2nd time in the last 2 years I get a call like this.

These guys suckered me in by saying that a court document will be delivered if I don't take care of this matter today. The fee: $200. Then they passed me off to a company called Waterman Financal group to receive the money. They said I could pay $530.00 in installments of $77.00. The client who contacted them to collect this supposed debt was Advance America. Which I found later that I had already resolved that with them

I just got a message from my mom saying that a certain "INVESTIGATOR MILLER" called regarding an "alleged check fraud" activity. It wasn't an automated message. My mom spoke to a live person "MILLER". He gave a document # and says for me to call them or else they will arrest me at my place of employmen

I don't have any checks in my name and the last check activity I did was cash a government check (IHSS provider). I probably have some outstanding debts out there but nothing major-nothing compared to the nature of this call.. I don't want to call, for my own personal security, but how can I find out if this is real or not?

If you know you have debts, contact the people or companies you owe and ask about your account. If you don't have any issues with your current accounts, the caller could be a fake.

This FTC article explains more about fake debt collectors.

A caller may be a fake if he

  • wants you to pay a debt you don't recognize
  • refuses to give you a mailing address or phone number;
  • asks for personal or financial information
  • pressures you to scare you into paying, by threatening to have you arrested or reported to law enforcement

I've gotten a couple voicemails from a Michael Miller who says he's an independent courier and that he will be at my residence at 4 pm today (10-20-2016) with some sealed documents that I need to sign for. He also gave me a number to call if I wanted to request a stop order (which sounds like a trap to me) along with a case number to go with it.

It sounded fishy because about two months ago, I received a voicemail, also from a "Michael" (I don't know if it's the same guy) with STP Management Group, threatening that I have two pending cases against me and that I can be criminally prosecuted if he doesn't hear back from me. He also used my date of birth and the name of my workplace as if I was supposed to be intimidated.

He probably got this info from an online payday loan application I submitted. My concern is, even if I do have a legitimate debt, it's my understanding that if you are to be served with papers, they wouldn't contact you prior to doing so. This sounds like a clear cut case of harrassment. I don't intend to call him back or make contact with him in any way. But what should I do if this "Michael" continues to pursue me? I've already submitted a complaint to the FTC regarding STP Management, as I have read several reviews online saying that it was a scam.

If you have a debt, you can contact the lender and ask about your account. Ask the lender if it hired a debt collection company to contact you.

If you don't have a debt, and you think someone is misusing your personal information, this article about fake debt collectors has tips to help.

They are at it again. I get calls from several states, several times per day, AND my family members, AND my extended family members, about debts that are WAAY past the statute of limitations or completely fake! Who will stop them? We need to setup a website where we can enter in these scams and the FBI / FTC/ Whoever can see the phone numbers and the messages they are leaving. They're claiming to be from Chicago and Arizona when they call me as Thompson, Scott & Associates. Bogus!

There is a way to tell law enforcement about calls you're getting.

Report them to the FTC at FTC.gov/complaint. The details you give will go into a secure database that local, state and federal law enforcement use for investigations.

I also got calls a few months ago (that stopped) from an "Investigator". I looked up their number (through a paid service) and it was coming from a house in TX. Texas state law says you must have a bond in place to be a debt collector. They have public records for real debt collection agencies online, but this guy wasn't listed.
I have his address if the FTC is interested.
