Bogus debts, bogus collections

At the FTC, we sue abusive debt collectors and try to do right by people who’ve been harmed by unlawful practices. But we also try to protect people from being harmed in the first place. That’s exactly why I’m here: to warn you about debt collectors calling about debts that the FTC knows are bogus.

The bogus debts supposedly are payday loans from these companies: USFastCash, 500FastCash, OneClickCash, Ameriloan, United Cash Loans, AdvantageCashServices, or StarCashProcessing. The companies are real, but if you’re hearing from anyone other than those companies, the debts are fake and you don’t need to pay.

Sometimes, if they can’t collect money owed to them, companies sell lists of those debts to debt collectors. But, in this case, we know that didn’t happen. The company that processed and serviced loans from these companies told the FTC that it never sold any customer or account information to debt collectors. Their lawyer even filed a legal declaration saying that.

Even so, we’ve still heard about abusive calls from debt collectors claiming to be collecting money owed to the companies listed above – and we already know that’s not true. But we also know that many of the people who have been called never even had a loan with those lenders in the first place – so the debts themselves also are bogus.

What to do if you get a call from a debt collector who says you owe money to one of those companies? You have rights. Ask for a validation notice, which says what you owe and to whom. After you get it, consider sending a letter saying that you don’t owe the debt. If you’re getting debt collection calls, check your free credit report at annualcreditreport.com. If a debt you don’t recognize shows up there, follow the instructions to dispute the debt. And, as always, report any problems to the FTC.

That sounds a lot like Dish Network they seem to be good at it , Time for class action suit

I closed an account with Dish and paid my bill and sent back all of their equipment because Dish raised my rates from 120 dollars to 175 dollars in a 18 month span. 2 months later they claimed I owed 144 dollars for breaking a contract. I set this up on the phone, no contract signed. And who would sign a contract that lets a company raise rates like that. Next thing I know I get a credit report that has a collection on it from GS for Dish. They screwed with my credit report and score.Is that even legal?

If Dish says you have a contract, ask them to send you a copy of the contract. See if your name is on the contract. See what the contract says about charges for ending a contract early.

So why can't you do anything about the bogus Bank mortgage debt collection methods. The Fed legal actions all seem aimed at making the MBS investors wealthy(er), but no help for the borrowers who got screwed. HAMP and the other Fed programs are ignored by the banks.

The federal government and local FBI agencies cannot actually do a forensic audit at at least Wells Fargo in TD Bank do to their current software they're using there is no let's call real backup system which this system should be by law eradicated that's why they want you to go paperless because if something were to happen it would be your word for stairs and when you're standing in front of the judge who's the one saying the other ones crazy when you have two pieces of paper with two different things on it! don't go paperless do not go paperless even if it saves you money.

I HAVE BEEN IN CREDIT CARD DEBT FOR APPROXIMATELY 17 YEARS, BUT THANKFULLY HAVE BEEN DEBT-FREE FOR OVER THREE YEARS!!! HOW DID I DO IT? BY MAKING A COMMITMENT TO PAY OFF MY DEBTS TO ALL OF MY CREDITORS VIA COLLECTION AGENCIES. SINCE THEN, I HAVE MADE A PROMISE TO NEVER GET INTO CREDIT CARD DEBT AGAIN BY NOT CHARGING MORE THAN I COULD PAY EVERY MONTH (ESPECIALLY SINCE CREDIT CARDS CHARGE A LATE FEE IF YOUR PAYMENT IS LATE AFTER JUST ONE DAY!!! ALSO, TRY TO MAKE MORE THAN JUST THE MINIMUM PAYMENT EVERY MONTH (ANOTHER THING I DID TO ELIMINATE MY CREDIT CARD DEBT). HOWEVER, I ALSO TRULY BELIEVE THAT COLLECTION AGENCIES SHOULD NOT ONLY TRULY BE LEGITIMATE AGENCIES, BUT THEIR CUSTOMER SERVICE REPRESENTATIVES SHOULD TREAT THEIR DEBTORS CIVILLY!!! AND, OF COURSE, THE ONLY SURE-FIRE WAY TO NOT GET INTO DEBT IS TO NOT GET A CREDIT CARD IN THE FIRST PLACE (DITTO FOR BORROWING LOANS, MORTGAGES, FROM FRIENDS, ETC.).

I get these threatening calls at least once a week. When they know I know they are a scam they curse me out and hang up on me

Same here. When I asked them to send me a validation notice he told me to shut my mouth up. I heard women in the background talking about putting lemonade in the freezer. Real legit!!

This is so old...guy from " IRS" has middle East accent...SO fake and they will curse you very when you uncover the sheets!

Same here!! Guy with foreign accent calls and tells me I'm going to jail if I don't send a payment in. I yelled at him and he hung up on me!

It is very important the debt collector to be monitord at local and state agency and get regulated.They charge tremendous interest charges close to 100 percent and no one wants to take responsibility for it,They act like lender ans beyond it is more than usury law and they do not required any licensing or accountability. The following is one of them. CALIFORNIA BUSINESS BUREA is not state Agency their name is misleading and perhaps is illegal. But yet get old medical bills where the debtor already settled with the medical provider and trying get it on your credit report illegally.this is not right and they have done it to many people.

I have numerous things on my credit that should not be there I get calls from different numbers all the time and they changed the dates on supposedly when I got this loan what do I do

What about them? They are predatory, sell overpriced merchandise and have NO interest in working with you if "Life" happens.

I just received a phone call from the "IRS" informing me that this was my last chance to "pay up". I do not owe back taxes and the phone # for the caller is 304 993-4716. thought you would like to know.

This is happening to me now, especially scams I have encountered and debt collections and would like more info on protecting myself and what actions I can take to stop these companies and debtors.

We keep getting nasty calls from some place in White Salmon, WA. When we ask for info, they get nasty and say, "...well, when you wind up in court, you'll be really sorry...!", and threats in that line. Tried calling the number back once and got "...don't know why you're calling here. I didn't call you...!" or "...don't you dare call this number again...!". Don't know what's happening but, wish they(whoever they are)would cease and desist.

Maybe the worst scammers involve the demand for immediate payments of a power bill. Everyone has a power bill, far more than a payday loan. Several local warnings in the Los Angeles area, but the scam could run nation-wide.

I get these calls all the time, never stops,theatening, scamming, told them, youhsve my info3, send to my address, validate debt, right away their is an arrest warrant in my name , that never happens, no one call, email you to let youknow, they will just show up,and arrest you, not for a debt...stop it please,fraud scam, bogus people....

Same thing. This has been happening to me for over 2 years. According to them there is either an arrest warrant or they are about to file papers. It is so frustrating.

Since the legal declaration states the money was lent by various Native American tribes,doesn't this add an additional wrinkle into this issue? Could the Dep't of the Interior be of any assistance to consumers or the FTC?

Yesterday I had a call from a man claiming to work for my local power company, telling me someone would be at my house within the hour to cut off my power for lack of payment, unless I paid him via credit card over the phone. He argued long enough for me to look up Ga Power's website which showed I was up to date. I then called Ga Power who agreed with me and confirmed it was a scam His (Cell?) phone number is recorded in my phone log as 912 495 7086. Please be aware.

I've been getting calls from a bogus company called Retrieval Mediation Services, phone# 1 312 465 1378, telling me I took out a phony payday loan. They keep saying they're going to garnish my wages and "serve me!"

I get these calls too. It's a scam. I've reported them to the FTC, and the Consumer Protective agency. I'm so sick of their crap.

Got a call today from 803-232-9872 telling me I was going to be "served" with "legal documents" from some company called Statewide, a quick Google search brought up HUNDREDS of complaints and filings against these idiots....why don't they just GIVE UP??

I am getting calls everyday from 732 2563111. I dont get it they leave messages to call 8882400182 saying they are global services. How they got my name and social security number. I dont know

I am glad to hear this. I get several calls a week from these characters. Most of them still using autodialers and spoofing caller ID. I have one at present that continually calls my cell spoofing a 269 area code. I have probably blocked at least a dozen of their spurious numbers.

What if a creditor releases information concerning a debt owed to someone other than the person that owes the money can anything be done, the person that was told was a spouse be the person calling had no way of confirming na spouse was on the line. Can anything be done?

If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don’t have an attorney, a collector may contact other people – but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney.

If you think a debt collector has violated the law, you can report it to the FTC at FTC.gov/complaint and to your state Attorney General’s office.

I received a call from a person who claimed to be an Inter-natiional debt collector.The phone # was 1-765-313-9812.7:18PM April20th. Fraud call?

I just heard from these guys today. They had all my personal info including my SSN. It worries me that they have that much information. They even faxed paperwork to my POE requesting my employment information. Thankfully my POE is a small company and the paperwork was given direct to myself. This had me very stressed out today and caused me to miss work due to the stress and medical situation it put me under. I have filed paperwork with the FTC and my State Attorney Generals office. I have also contacted my local police. I won't take any chances with these people.

OMG I was just contacted last Saturday out of the blue while I was waiting on a legitimate phone call from a delivery service they claimed that they were from Dish and I owe $500 cause bill wasn't paid since Feb. What is scary as you said they had my name, address and even last four of Social but as I told them I have Dish, they are paid to date and even coming for an appointment on Jyl 3, 2017 so you are a scammer. They've called every day since. Agrivating and very scary of all my personal information that they have. How did they get it?!

What do you do when the debt is owed by someone who had your phone number 6 years ago, you tell the collection agencies they don't have this number anymore and the still keep calling. Talk about frustrating!

Good information. How do you proceed after you are harassed over the phone, specially when the caller claims to be from the IRS.

You can report the call to the FTC and the Treasury Inspector General for Tax Administration (TIGTA).

I receive letters that debt that is not mind. What can I do about that. I have never had the debt

Debt collectors must follow rules when they write to you or call you. You can tell the debt collector to give more information about the debt.

The law says debt collectors must send you a written notice about the debt. The notice is called a “validation notice.” The notice must say:

  • how much you owe
  • who you owe the money to
  • what to do if you do not owe the money

When you get the validation notice:

  • Read it. Do you know the debt? The notice should name the “creditor.” The creditor is the person you owe money to. You can call the creditor to get more information. 
  • The notice tells what to do if the debt is not yours.
  • If the debt is yours, make a plan for how to pay it.

If you need help to pay a debt, you can go to a credit counselor. A credit counselor can help you make a plan to pay debts. This government website lists credit counselors in every state.

As someone who has been through the steps to have inaccurate information removed from my credit report, a "validation notice" appears meaningless to these people. They simply say the debt is yours and proceed from there. This was a couple years ago, and hopefully some things have actually changed. But for everyone out there who has been through this little slice of hell, the burden should fall on collection agencies to validate info from bulk portfolio purchases. They should be fined significantly for placing inaccurate information on someones report, knowing that it common for many consumers to just pay, rather than spend countless hours trying to prove that they are innocent, including filing "identity theft" charges against someone simply with your name who may or may not exist. Some of this is just crazy and these people make way too much money on the misery of others.

People are out there pretending to agents from ftc and also from NAUPA. Thank god i do my home work and double check on who is really who. They still call but i dont answer.i reported to Nickie over there.Gave her all the phone numbers they call from.

Got a call yesterday from a Guy telling me he was from Card Payment Services and I had been paying so well and above the min. amount for some time now they wanted to give me a reduced rate of interest for 2 of my highest credit cards !!!

So which ones would I like the reduced rate on ? He had my name,first digit of my Visa, I chose, then asked to confirm my address, which I did, then gave him the last 4 digits of my CC number,

But when he asked for the last 4 digits of SS I said Wait a Minute !!! No way I'm giving you Those Numbers...He laughed then I said good try and good bye, then hung up phone. But I'm afraid I still gave too much info, so I called cc company,which by the way he had the correct phone number to, and cancelled the card.

Still wondering if I should put a Freeze on Credit Reporting Agencies ????????????? Don't know how much damage that would cause me to get back off from.... FYI
